Accident Terms and Definitions

Comparative negligence
Negligence of a plaintiff in a civil suit which decreases his recovery by his percentage of negligence compared to a defendant's negligence.

No-Fault Auto Insurance
Some states are adopting a no fault auto insurance system which requires you to have minimum insurance in the event you're injured. Your insurance company automatically pays for your damages, regardless of who is at fault for the accident.

Misdemeanor
Criminal offenses less than felonies; generally those punishable by fine or imprisonment of less than 90 days in a local facility.

Affidavit
A written or printed declaration or statement under oath Affirm - The assertion of an appellate court that the judgment of the lower court is correct and should stand.

Omnibus hearing
A pretrial hearing normally scheduled at the same time the trial date is established. Purpose of the hearing is to ensure each party receives (or "discovers") vital information concerning the case held by the other.

Excessive speed & Speeding
Speeding is defined as travelling faster than the posted speed limit, or travelling too fast for the road conditions even at speeds under the posted limit.

Triangulation
Technique for scene documentation where items of evidence are located by measuring the distance between two (2) reference points.

Choice no fault
In some state a hybrid no fault system known as " choice no fault " exists. In these states, you may choose to be insured under a strict no-fault plan, in which case you're unable to sue an at fault driver and also can't be sued if you're at fault.

Pedestrian Manifestations
Those items of evidence deposited at the collision scene by the pedestrian during or following impact.

Failure to signal
There are laws and driving rules that instruct proper turning signals, at time a hand or a light signal is required to be used. A right hand turn may not be permited, or a turn in an intersection may be done incorectly.
